US compliance readiness for brands selling on Amazon.com from outside the US

LIVELE's US Compliance Readiness is a fixed-scope project for brands based in Latin America, Spain or elsewhere that sell, or plan to sell, on Amazon.com. We check each product category against US rules for product safety, food, cosmetics, pesticides and radio devices, set up listing compliance in Seller Central, record your Account Health baseline and set up role-based account access. The price is quoted on request. PPC is not included.

You may not need a US company. You do need US-compliant products.

Amazon says a business based in Latin America may not need to form a US company to sell in the US, and can use a Professional North America and Brazil unified selling account (Amazon Global Selling). Opening the account is the easy part.

The products still have to meet US rules, and Amazon asks for proof. A toy needs a Children's Product Certificate based on testing by a lab accepted by the Consumer Product Safety Commission (CPSC).

A cosmetics facility has to be registered with the Food and Drug Administration (FDA). A product that claims to repel insects can be a pesticide that needs registration with the Environmental Protection Agency (EPA). A radio device with Federal Communications Commission (FCC) equipment authorization carries an FCC ID, which online marketplaces must display at the point of sale from March 1, 2027.

Costs changed too. Duty-free de minimis treatment ended for shipments from all countries on August 29, 2025, which changed the landed cost of small shipments to the US.

Questions from brands outside the US

Do I need a US company to sell on Amazon.com from Latin America?

Possibly not. Amazon says a business based in Latin America may not need to form a US company to sell in the US, and can use a Professional North America and Brazil unified selling account. Your products still have to meet US requirements, and your tax and import obligations depend on your setup, so check those with your accountant or customs broker. What documents do I need to sell my products in the US?

The documents depend on the product category. Children's products need a Children's Product Certificate based on testing by a CPSC-accepted lab. Cosmetics facilities register with the FDA under MoCRA, and products are listed. Supplements fall under the FDA's cGMP rule, 21 CFR Part 111. Products with pest-control claims may need EPA registration. Radio devices with FCC equipment authorization need their FCC ID on the listing. The free compliance document checklist lists them by category.

Does de minimis still apply to my shipments to the US?

No. Duty-free de minimis treatment ended for shipments from all countries on August 29, 2025, under Executive Order 14324. That changes the landed cost of small shipments and direct-to-customer parcels, so check your numbers with your customs broker. What happens after the readiness project?

You keep the gap register and the document files, and your team can maintain them. If you want someone to own that work, Compliance Management continues it at $3,500/month: monitoring, cases, Plans of Action and document custody by category. Nothing in the readiness project requires a retainer.
